Your California, Colorado, Connecticut, Virginia, and Utah Rights Regarding Personal Information

Section 6 of the Privacy Statement uses certain terms that have the meanings given to them in the California Consumer Privacy Act and its implementing regulations (the “CCPA”) and as amended by the California Privacy Rights Act and its implementing regulations(“CPRA”) (Effective January 1, 2023); The Colorado Privacy Act (Effective July 1, 2023); the Connecticut Data Privacy Act (Effective July 1, 2023); the Virginia Consumer Data Protection Act (Effective January 1, 2023); and the Utah Consumer Privacy Act (Effective December 31, 2023). This policy applies to residents of these states as of the effective date of each state’s law.

If you are a resident of one of these states, you have certain rights with regard to your Personal Information:

▪ Access / Portability – You may request, up to two times every 12 months, that we disclose to you the following: the categories of personal Information that we have collected about you; the categories of sources from which we have collected personal Information about you; the categories of personal information that we have disclosed about you for our business purposes in the last 12 months and the categories of third parties to whom the personal information was disclosed, by category or categories of personal information for each Third Party to whom the personal information was disclosed; and the specific pieces of personal information that we have collected about you.

▪ Deletion – You have the right to request that we delete your personal information, subject to certain exceptions allowed under applicable law. ▪ Opt-Out / Do Not Sell My Info – The NAI Consumer Opt-Out gives you the right to request to opt-out of the Sale of your Personal Information to third parties. For purposes of this Privacy Policy, “sell” means the sale, rental, release, disclosure, dissemination, availability, transfer, or other oral, written, or electronic communication of your personal information by Tifosi Optics to a third party for monetary or other valuable consideration.
▪ Opt-Out / Do Not Sell My Info – The NAI Consumer Opt-Out gives you the right to request to opt-out of the Sale of your Personal Information to third parties. For purposes of this Privacy Policy, “sell” means the sale, rental, release, disclosure, dissemination, availability, transfer, or other oral, written, or electronic communication of your personal information by Tifosi Optics to a third party for monetary or other valuable consideration.

▪ Correction of Inaccurate Personal Information: You have the right to request if inaccurate personal information is represented. To correct that inaccurate personal information please submit this form to privacy@tifosoptics.com . Tifosi Optics has 45 days of the consumers request after we have verified to the best of our abilities the request is accurate. We have the right to extend this timing another 45 days when reasonably necessary provided Tifosi Optics notifies you with in the first 45 day period using method provided in the submission. You may request the correction of inaccurate personal information by mail to Tifosi Optics, Privacy Department, 1011 Industrial Blvd., Watkinsville, GA 30677. Tifosi Optics has the right to deliver any communication regarding the correction and extension through writing and delivered by communication choice elected by the consumer.

You will not be discriminated against for exercising the above rights. You may exercise these rights by calling 1-866-310-0996 or for more information check out the Tifosi Optics Privacy Request Form. We may take reasonable steps to verify your identity prior to responding to your requests. Note that we may deny certain requests, or fulfill a request only in part, based on our legal rights and obligations. For example, we may retain Personal Information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, and to process transactions and facilitate customer requests. California residents may designate an authorized agent to make a request on their behalf. When submitting the request, please ensure the authorized agent is identified as an authorized agent.

We ask that you read this Privacy Policy before using the site. This privacy policy complies with the California Consumer Privacy Act of CCPA as well as the updated CCPRA.

Please write “California Shine the Light” in the subject field of your email or include it in your written request. You must include your name, street address, city, state, and zip code. We are not responsible for notices that are not labeled or sent properly, or do not have complete information.

▪ We collect the following categories of personal information as described under applicable state law: personal identifiers; information necessary to provide our products and services to you; commercial information; categories of personal information described in Cal. Civil Code section 1798.80(e); characteristics of protected classifications under California or federal law; professional, employment-related, and educational information; internet or other electronic network and app activity information; geolocation information; and inferences.

▪ We collect these categories of personal information directly from you, passively from your devices, from service providers, from our affiliates, and from certain other parties, as described in Section 2 above.

We MAY collect, receive, use and share personal information for the following work-related individuals. We do not:

Tifosi Optics will collect, receive and use Name, Postal Address, Email address, Phone number. We will collect information such as work availability, qualification, employer history and experience, compensation, and military service. We will only share this information with company personnel involved in the hiring and recruitment.

Tifosi Optics will hire the best qualified applicant based on education info, past job experience. Tifosi Optics does not discriminate against race, color, national origin, religion, sex, disability, age, citizenship status, marital status, gender identity or gender expression, medical conditions, military or veteran status.

Tifosi Optics will only collect sensitive personal information such as social security number, driver’s license number, and date of birth in order to conduct a criminal background check. We will share this information with applicable law enforcement and governmental agencies.

We collect, receive, use, and share work-related information for independent contractors as described below:

Name, business/company name if applicable, postal address, Taxpayer Identification number (if applicable), W-9 information in form format, sensitive personal information such as social security number or state card number as well email address, business website, and phone number.

We may collect your resume with qualifications, experience, other companies represented as a 1099.

We will use this information to establish and manage our independent contractors, verify your identity and comply with our legal and contractual requirements.

Tifosi Optics may share this information with company human resources, management, IT personnel, and service providers.
