This privacy policy ("Privacy Policy") describes how and why Tifosi® Optics, Inc. (collectively, "we," "us," or "our") and our service providers collect, use, disclose, protect, and otherwise process information that identifies, relates to, describes, could be associated with, or could be linked to you or your household ("Personal Information") when you visit tifosioptics.com (the "Website"), purchase a product from us, or interact with us in any other way (collectively, the "Services"). "Sensitive Personal Information" has the meaning assigned under applicable privacy laws and may include certain categories of information requiring heightened protections, which may include certain prescription or vision-related information. For purposes of this Privacy Policy, "you" and "your" means any user of the Services, whether you are a customer, website visitor, or another individual whose information we have collected pursuant to this Privacy Policy. The use of information collected through our Website shall be limited to the purposes under this Privacy Policy, our Terms of Service, and any other policies expressly incorporated herein by reference (collectively, the "Terms"). This Privacy Policy does not apply to the practices of companies or websites that we do not own or control. See Section 13 for your state privacy rights.

1. What Information We Collect

We may collect Personal Information directly from you, from third parties, and automatically through your use of our Services. We may combine information collected from or about you from these various sources.

Personal Information you disclose to us

The Personal Information that we collect and use varies depending on how you interact with us. We receive and store any information you knowingly provide to us when you create an account, make a purchase, subscribe to our communications, submit a warranty claim, apply for a job, or fill out any online forms. The Personal Information we collect may include the following:

  • Contact Information including your name, address, zip code, phone number, and email;
  • Product and Preference Information including what products you purchase or search for, the product line, purchase date, purchase price, and purchase location;
  • Transaction Information including your billing address and payment information, such as credit card number, debit card number, or other financial information. Payment transactions are processed through third-party payment processors and service providers that maintain their own privacy and security practices;
  • Account Information including username, password, and security questions;
  • Customer support information including the information you choose to include in communications with us, for example, when sending a message through the Services or submitting a warranty claim;
  • Employment-Related Information when you apply for a job, including your work experience, education history, resume, the URL to your personal or professional websites, workplace skill sets and certifications, salary history and requirements, and any other information you choose to provide as part of your application. Where voluntarily provided in connection with employment applications, this may also include equal employment opportunity, workforce demographic, veteran status, disability status, or similar information permitted by applicable law;
  • Usage Data such as device and usage information, IP address, browser and device characteristics and history, operating system, language preferences, referring URLs, device name, date and time stamps, and general location inferred from your IP address;
  • Location Information including general location inferred from your IP address;
  • Inferences drawn from other Personal Information collected about you, reflecting what we believe to be your preferences, characteristics, predispositions and attitudes; and
  • Prescription and Vision-Related Information including prescription information, pupillary distance measurements, lens specifications, or other vision-related information that you voluntarily provide in connection with the purchase of prescription eyewear products. We recognize the sensitive nature of prescription and vision-related information and implement administrative, technical and organizational safeguards designed to protect such information. Prescription and vision-related information may be transmitted to and processed by authorized third-party service providers, including prescription verification providers, lens processing laboratories, ecommerce platform providers, and fulfillment vendors solely for purposes related to processing, verifying, manufacturing, fulfilling, supporting, and servicing your prescription eyewear order, complying with applicable law, and maintaining our Services.

2. How We Collect Information

We collect Personal Information about you from various sources, directly and indirectly, including the following:

  • Directly from you when you register with our Website, make a purchase, use any of our services, sign up for our email newsletters, submit a warranty claim, apply for a job, or otherwise contact us. The decision to provide this information is optional. However, if you choose not to provide the requested information, you may not be able to make purchases or use some or all of the features of the Website or Services.
  • Automatically from your devices through cookies, web beacons, or other tracking technologies to automatically collect information.
  • Through software applications made available by us for use on computers and mobile devices.
  • From service providers we engage such as those that host, protect, or maintain our Website; send promotional emails for us; help with customer communications and customer service; conduct research and analytics for us; or provide marketing and advertising services.
  • From other businesses such as our business and marketing partners and social media platforms that give us information they have collected either directly or indirectly from you. We may also receive employment-related information from a job network or social network if you choose to import your information from those platforms when applying for a job with us.

We may combine the information we receive from other parties with information we collect ourselves. We combine information collected offline, such as information collected about you when you interact with our customer service team or at a consumer show, with information collected online. We also combine information collected across devices, such as computers and mobile devices.

3. Cookies

Like many websites, we use cookies and similar technologies to power and improve our Services, including by remembering your actions and preferences, running analytics, and better understanding how users interact with the Services. Cookies are small text files that a web server places on your device. They are uniquely assigned to you and can only be read by a web server in the domain that issued them. Cookies cannot be used to run programs or deliver viruses to your computer.

We use both first-party cookies that we set directly, and third-party cookies and similar technologies (such as pixels, tags, and SDKs) set by our partners, ecommerce providers, analytics providers, advertising partners, and service providers. These tools help power core commerce features, remember your preferences, measure Website and ad performance (including conversions), build and refine audiences, and tailor the Services, products, and advertising you see on and off our Website. Information collected via these third-party tools may be used by those third parties in accordance with their own privacy policies. The specific partners and technologies we use may change over time as we improve our Services and work with new providers.

Types of Cookies We Use:

  • Strictly Necessary Cookies. These cookies are essential for the Website to function and cannot be disabled. They enable core functionality such as secure checkout, shopping cart management, discount functionality, and currency recognition.
  • Performance Cookies. These cookies are associated with our analytics suite and help us understand how visitors interact with the Website. We use this data to analyze Website usage and improve performance.

You may update your cookie preferences at any time by using the cookie banner on our Website. Your cookie and advertising preferences may be browser- and device-specific, meaning you may need to update your preferences separately on each browser and device you use to access the Services.

We do not control third parties' collection or use of your information for interest-based advertising, but these parties may offer ways to opt out. Most browsers are configured to accept cookies by default; however, you can adjust your browser settings to remove or reject cookies through your browser's built-in controls. Please note that removing or blocking cookies may negatively affect your user experience and may cause certain features and general functionality to work incorrectly or become unavailable. Additionally, blocking cookies may not completely prevent the sharing of information with third parties, such as our advertising partners.

We may work with network advertisers, ad agencies, analytics service providers, and other vendors to serve advertisements on the site and in connection with the services; to serve our advertisements elsewhere online; and to provide us with information regarding use of and traffic on the site and in connection with the services. These advertisements may be tailored based on information collected automatically (through tracking tools like cookies and web beacons) about your activities in connection with the site and other web sites you visit, over time and across different devices, and across the various web sites and platforms you visit. If you would prefer not to have your online activity tracked for purposes of receiving interest-based advertising you can opt-out with the NAI Consumer Opt-Out tool or the About Ads option.

Do Not Track Signals

Some Internet browsers may be configured to send "Do Not Track" signals to the online services that you visit. There is no consensus among industry participants as to what "Do Not Track" means in this context. Like many websites and online services, the Website and our Services do not alter their practices when we receive a "Do Not Track" signal from a visitor's browser.

4. How Do We Use Your Information?

We process your Personal Information for a variety of reasons, depending on how you interact with the Services, including:

  • To provide you with the Website and Services;
  • To enable your transactions, such as fulfilling all orders or otherwise communicating with you about your transactions via phone, email, SMS-messaging, USPS/Shipping services (not limited to those above);
  • To maintain, operate, and improve our Website, products, and the Services;
  • To customize and personalize your experience;
  • To process prescription eyewear orders, including transmitting prescription and vision-related information to authorized prescription verification providers, lens processing laboratories, manufacturing partners, and fulfillment vendors involved in processing and fulfilling prescription eyewear purchases;
  • For marketing purposes, such as to tailor and send you information about new products or services we think you may be interested in and to serve you targeted advertising on other platforms and websites;
  • To respond to your requests and inquiries;
  • To conduct research and analyze the effectiveness of our marketing efforts and the Website;
  • For hiring purposes, such as to evaluate job applications;
  • To protect our company, affiliates, and customers from fraud or harmful or illegal activities;
  • To comply with our legal obligations and enforce our legal rights;
  • To verify requests made pursuant to this Privacy Policy; and
  • As we may otherwise notify you or obtain consent from time to time.

We may use information that is not personal information for any lawful purpose.

Artificial Intelligence and Automated Tools

We may use artificial intelligence, machine learning, automated systems, or similar technologies to support certain Website functionality, customer service interactions, product recommendations, content generation, marketing, analytics, fraud prevention, and operational processes. These tools are intended to assist and improve our Services and are subject to human oversight where appropriate. Certain images, videos, marketing materials, or other content made available through the Services may be enhanced, modified, or generated using artificial intelligence or similar technologies.

Profiling and Automated Decision-Making

We do not use automated decision-making that produces legal or similarly significant effects without human involvement. Where we use profiling for targeted advertising or marketing optimization, you may opt out as described in this Privacy Policy.

Prescription Information and Advertising

We do not use prescription or vision-related information submitted in connection with prescription eyewear purchases for cross-context behavioral advertising, targeted advertising based on health-related characteristics, or marketing profiling purposes.

5. When and With Whom Do We Share Your Information?

We may share your Personal Information with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work.

We do not sell or disclose any Personal Information about you to any third party except to provide you with products or services you have requested, where we have your consent, or under the circumstances listed below:

  • With our service providers for our own business and operational purposes. From time to time, we may share information with service providers, such as those who send emails for us, help us manage and operate the site, process payments, process and fulfill orders, provide advertising or marketing services, provide analytics and search engine support, track advertising impressions, investigate and prevent fraud or illegal activity, provide physical and digital security services, audit our business and financial statements, provide legal advice, place our advertisements on other platforms, or perform other business functions on our behalf. For prescription eyewear purchases, this may include sharing prescription and vision-related information with prescription verification providers, lens processing laboratories, ecommerce platform providers, manufacturing partners, and fulfillment vendors involved in processing and fulfilling your order.
  • With our business partners and marketing companies. We may share information with other companies that co-sponsor a promotion or promote our products. We may share information with, or make information available to, advertisers, search providers, and ad networks (collectively, "Advertisers"). Advertisers may collect and use information about your use of the Website or Services as well as other websites and services in order to provide advertisements about goods and services that may be of interest to you. Our Privacy Policy does not cover any use of information that an Advertiser may collect from you. Advertisements may be shown via the Website, the Services, or on third-party websites. Some of these disclosures may be deemed a "sale" under certain state laws.
  • With other services and applications. Through the Website and the Services, you may have the ability to elect to access other services and applications, such as Facebook and other social networks. Depending on your privacy settings, some of those services may provide us with information from your accounts, which may enable us to enhance and personalize your use of the Website and Services. You may be able to control or block such sharing by changing your privacy settings in such services or applications. Some of these disclosures may be deemed a "sale" under certain state laws.
  • Virtual try-on experience. Our Website offers a virtual try-on feature that allows you to preview eyewear products using your device camera or uploaded image. Images used in connection with the virtual try-on experience are processed in real time solely to provide the functionality of the feature during your session. Tifosi Optics and its service providers do not store, retain, sell, lease, or otherwise use such images or any biometric identifiers or biometric information for identification, authentication, profiling, marketing, or any purpose unrelated to providing the virtual try-on functionality. Any screenshot or images you choose to save from the virtual try-on experience are stored solely on your personal device, and you are responsible for the security and safekeeping of such content.
  • To comply with the law or to protect ourselves, our customers and others. Tifosi Optics cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We may disclose Personal Information and any other information about you to government or law enforcement officials or private parties if, in our discretion, we believe it is necessary or appropriate in order to respond to legal requests (including court orders and subpoenas), to protect the safety, property or rights of Tifosi Optics or of any third party, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with the law. We might also share information when we are investigating potential fraud or illegal activity.
  • With a successor to all or part of our business. If Tifosi Optics is merged, acquired, or sold, or in the event of a transfer of some or all of our assets, we may disclose or transfer personal information in connection with such transaction. We may also share your information with others as they conduct diligence of our corporate changes.
  • For any other reasons we may describe to you from time to time or as permitted by law.

We may also disclose aggregate, anonymized, or de-identified information about users for marketing, advertising, research, compliance, or other purposes.

Sale/Share/Targeted Advertising Disclosures

We do not sell Personal Information for money. We may "sell" or "share" Personal Information as those terms are defined by certain U.S. state privacy laws by allowing advertising, social media, and analytics partners to collect Personal Information via cookies or similar technologies in our Services for cross-context behavioral advertising and measurement. You may opt out of such "sale," "sharing," and "targeted advertising" at any time by contacting us at privacy@tifosioptics.com or through the "Do Not Sell or Share My Personal Information" link available in the footer of our Website.

6. Accounts

When you create an account with us, we may send a verification email to confirm ownership of the email address used during registration. If you choose to receive marketing communications, we may send you promotional emails, newsletters, product updates, and other marketing communications. You may opt out of marketing emails at any time by clicking the "unsubscribe" link included in our emails, adjusting your account communication preferences (if available), or contacting us at privacy@tifosioptics.com.

Our emails may contain tracking technologies that help us understand whether messages are opened, links are clicked, and how users interact with our communications. We use this information to measure the effectiveness of our marketing campaigns, improve our communications, and better tailor content to user interests. We may also use third-party email marketing or analytics providers to facilitate and analyze these communications.

You may also choose to create or access an account through supported third-party login providers such as Shopify. If you use a third-party login provider, we may receive certain account information from that provider in accordance with the permissions you authorize at the time of login.

7. User Generated Content

The Services may enable you to post product reviews and other user-generated content. If you choose to submit user generated content to any public area of the Services, this content will be public and accessible by anyone.

We do not control who will have access to the information that you choose to make available to others and cannot ensure that parties who have access to such information will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information you make publicly available, or for the accuracy, use or misuse of any information that you disclose or receive from third parties.

8. Your Choices; Communication Preferences

Marketing Emails

You can opt out of receiving marketing emails. If you do not want to receive promotional messages about our products and services, you may unsubscribe from those emails by clicking the link in the footer of all promotional email messages. Alternatively, you may email Tifosi Optics customer service (privacy@tifosioptics.com) at any time and ask to be removed from our email list. It may take up to seven (7) days for us to remove your email from our list. Even after that time, we may continue to send you email communications related to your transactions with us, including communications regarding account notifications, purchases, billings, shipments, returns, customer support questions and similar information regarding your use of the Website and Services.

Physical Mailings

You can opt out of receiving physical mailings. If you do not want to receive a physical catalog or flyer about our products and services, you may unsubscribe from these mailings by emailing us at privacy@tifosioptics.com. If you change your name and continue to purchase products from Tifosi Optics, you may need to submit an updated opt-out request under your new name by emailing us at privacy@tifosioptics.com. It may take up to seven (7) days for us to remove you from our physical mailing list.

Text Messages and SMS Communications

If you opt in to receive SMS or text message communications from us, we may send you transactional, promotional, marketing, or informational text messages, including messages sent using automated technologies. Consent to receive marketing text messages is not a condition of purchase. Message and data rates may apply. You may opt out of marketing text messages at any time by following the instructions provided in the message, including by replying STOP where applicable.

9. Third Party Websites

THE WEBSITE AND/OR SERVICES MAY CONTAIN LINKS TO THIRD-PARTY OWNED AND/OR OPERATED WEBSITES. WE ARE NOT RESPONSIBLE FOR THE PRIVACY PRACTICES OR THE CONTENT OF ANY THIRD-PARTY WEBSITE. We suggest that you contact these third parties directly for information regarding their privacy, security, and data collection and distribution policies prior to providing them with any information. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may be viewable by other users of the Services and/or users of those third-party platforms. We are not responsible for managing third-party communications; if you no longer wish to receive communications from a third party, please contact that third party directly. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

10. How Long Do We Keep Your Information?

How long we retain your Personal Information depends on different factors, such as whether we need to retain the information to maintain your account, provide the Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies. When we no longer have a legitimate business need to process your Personal Information, we will either delete or anonymize such information, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), we will securely store your Personal Information and isolate it from any further processing until deletion is possible. We retain Personal Information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy. Prescription and vision-related information is retained only for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including order fulfillment, customer support, legal compliance, fraud prevention, dispute resolution, and recordkeeping obligations.

11. How Do We Keep Your Information Safe?

We have implemented appropriate and reasonable technical, organizational, and administrative safeguards designed to protect the security, confidentiality, and integrity of Personal Information we process. Access to prescription and vision-related information is restricted to authorized personnel, service providers, and vendors with a legitimate operational need to access such information in connection with the Services and prescription eyewear fulfillment process.

Despite our safeguards and efforts to secure your information, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee that unauthorized third parties will never be able to defeat our security measures or misuse your information. Transmission of Personal Information to and from our Services is at your own risk. If we become aware of a data breach affecting Personal Information, we will investigate and provide notifications to individuals and/or regulators as required by applicable law.

Data Breach

If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. You should take steps to protect against unauthorized access to your password, phone, and computer including, but not limited to, signing off after using a shared computer, choosing a strong password that cannot be easily guessed, and keeping your login name and password private. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

If we determine or reasonably suspect a security incident affecting the Website or Services, including unauthorized access, acquisition, or disclosure of Personal Information, we will investigate, contain, remediate, and where appropriate or required by law, report the incident and notify affected individuals and applicable authorities without undue delay. We will cooperate with law enforcement and may provide notice by email and/or on the Website, as permitted by law.

12. Do We Collect Information from Minors?

The Website and the Services are intended for a general audience and are not directed at users under 18. We do not knowingly collect Personal Information from minors under 18, and users under that age must not use the Services. If you believe we may have collected Personal Information about a child under 18, please contact us by emailing privacy@tifosioptics.com with "Minor Data Collected Notification" in the subject line, and we will promptly delete such information.

13. Your Privacy Rights

Depending on your state of residence, you may have certain rights with respect to your Personal Information under applicable law, including:

  • Right to Know. You may have the right to request information about specific pieces of Personal Information we have collected about you, the sources from which we collect it, the purposes for which we use it, and the categories of third parties with whom we share it.
  • Right to Access. You may have the right to request a copy of the Personal Information we hold about you.
  • Right to Delete. You may have the right to request that we delete Personal Information we collected from you, subject to exceptions.
  • Right to Correction. You may have the right to request that we correct inaccurate Personal Information.
  • Right to Opt out of "sale," "sharing," or targeted advertising. You may have the right to direct us not to sell or share your Personal Information, or use it for targeted advertising.
  • Right of Portability. You may have the right to receive a copy of the Personal Information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.
  • Right to Withdraw Consent. Where we rely on your consent to process your Personal Information, you have the right to withdraw this consent.
  • Right to Restrict Processing. You may have the right to ask us to stop or restrict our processing of your Personal Information.
  • Right to Appeal. If we deny your request, you may have the right to appeal our decision.
  • Right to Non-Discrimination. We will never discriminate against you for exercising any of your privacy rights.

Exercising Your Rights and Complaints

To exercise your rights or if you have complaints about how we process your Personal Information, please contact us by emailing us at privacy@tifosioptics.com. If you are not satisfied with our response to your complaint, depending on where you live, you may have the right to appeal our decision by contacting us, or lodging a complaint with your local data protection authority.

Verification and Authorized Agents

We will verify your request using information associated with your account or interactions with us and may request additional information only as reasonably necessary to confirm your identity or authority, as permitted by law. We will not require you to create an account to submit a request. If you submit a request through an authorized agent, we may require proof of authorization (for example, signed permission from you or a valid power of attorney). For requests to know/access, delete, or correct, we may also require you to verify your identity directly with us. For requests to opt out of "sale," "sharing," or "targeted advertising," we will accept authorized agent requests upon sufficient proof of authority and will not require you to verify your identity directly as a condition of processing. We will not collect or use Personal Information beyond what is reasonably necessary to verify and process your request.

California Privacy Rights

California residents have the additional right to:

  • Know the categories of Personal Information we have collected, the categories of sources, the business or commercial purposes for collection or sharing, the categories of third parties to whom we disclose Personal Information, and the specific pieces of Personal Information we maintain about you;
  • Opt-out of the "sale" or "sharing" of Personal Information for cross-context behavioral advertising;
  • Limit the use and disclosure of Sensitive Personal Information to uses necessary to provide requested goods or services, maintain the security and integrity of our Services, comply with legal obligations, or as otherwise permitted by applicable law. Depending on applicable law and the nature of the Services requested, certain information we collect, including prescription and vision-related information, may constitute Sensitive Personal Information; and
  • Receive information about financial incentives, if offered.

Notice at Collection (California and similar laws)

We collect the following categories of Personal Information: Identifiers (e.g., name, email, IP address), Commercial Information (e.g., payment details, credit card information, and purchase or transaction history), Internet/Network Activity, General Geolocation Data, and Inferences. We collect these categories from you, your devices, our service providers, third parties (e.g., ad networks and analytics providers), and affiliate partners for the purposes described in Section 4. We may disclose these categories to service providers and contractors for business purposes and may "sell" and/or "share" Personal Information for cross-context behavioral advertising and engage in "targeted advertising" as described in this Privacy Policy. We retain Personal Information for the periods described in Section 10.

Financial Incentives

We may offer discounts, promotions, loyalty programs, sweepstakes, or other benefits in exchange for your participation in marketing programs, account registration, reviews, surveys, or similar activities that involve the collection, retention, use, disclosure, or sale/sharing of Personal Information. Participation in such programs is voluntary, and you may withdraw at any time by following the instructions associated with the applicable program or by contacting us at privacy@tifosioptics.com. Any financial incentive or price or service difference related to such programs is reasonably related to the value of the Personal Information provided to us.

"Shine the Light"

California Civil Code § 1798.83 permits California residents to request, once per year and free of charge, information about the categories of Personal Information (if any) we disclosed to third parties for their direct marketing purposes in the prior calendar year and the names and addresses of those third parties. To submit such a request, contact us using the information in Section 18.

California Minors' Content Removal

If you are a California resident under 16 and have an account on the Services, you may request removal of content you publicly posted by contacting us using the information in Section 18 and identifying the content. We will make the content no longer publicly visible on the Services, but complete removal (e.g., from caches or archives) may not be possible.

14. Governing Law

This Privacy Policy, and your access to and use of the Services, as well as any dispute, claim, or controversy arising out of or relating to them, will be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict-of-law rules or principles (whether of Georgia or any other jurisdiction) that would result in the application of the laws of any other jurisdiction. Any dispute between the parties that is not subject to arbitration or that cannot be heard in small claims court will be resolved exclusively in the state or federal courts located in Oconee County, Georgia and the parties consent to the personal jurisdiction and venue of those courts. Please review the arbitration provision in Section 21 of our Terms of Service.

15. Severability

If any part of this Privacy Policy is deemed unlawful and/or unenforceable, all other provisions contained herein will remain in full force and effect.

16. International Transfers

Our Services are operated from the United States and are primarily intended for users located in the United States. However, users from other jurisdictions may access the Website and interact with our Services. Please be aware that your Personal Information and communications may be transferred to, processed, maintained, and stored on servers and systems located in the United States and other jurisdictions where we or our service providers operate.
